NOTICE INVITING SEALED BIDS
HERITAGE VALLEY PARKS FOUNTAIN
ENTRY FEATURE RENOVATION PROJECT
SPEC NO. 16-04
PUBLIC NOTICE IS HEREBY GIVEN THAT:
Sealed bids will be received at the Office of the City Clerk, Fillmore City Hall, 250 Central Avenue, Fillmore, California, 93015, up to the hour of 10:00 A.M. Thursday, July 18, 2017, at which time they will be publicly opened and read aloud in the City Council Chambers, City Hall, Fillmore, California, for the following work:
The work to be done consists of furnishing all materials, equipment, tools, labor, and incidentals as detailed in the Plans, Specifications and Contract documents for the renovation of two existing Heritage Valley Parks Entry Feature Fountains to make them operational. The fountains are located at the southwest and southeast corners of the Highway 126 and Mountain View Street intersection in Fillmore, California, and other related work as described in the Specifications and Contract Documents, by reference, made a part hereof. This project is subject to compliance monitoring and enforcement by the Department of Industrial Relations.

Hard copies are available at in the City’s Public Works Department, 250 Central Avenue, Fillmore, California 93015, upon payment of a $30.00 non-refundable fee if picked up, or payment of a $50.00 non-refundable fee, if mailed. If a FedEx number is provided or alternative shipping fees are paid, the City will send out the documents for the pickup price.
Any contract entered into pursuant to this notice will incorporate the provisions of the State Labor Code. Compliance with the prevailing rates of wages and apprenticeship employment standards established by the State Director of Industrial Relations will be required. Affirmative action to ensure against discrimination in employment practices on the basis of race, color, national origin, ancestry, sex, or religion will also be required. The City hereby affirmatively ensures that all business enterprises will be afforded full opportunity to submit bids in response to this notice and will not be discriminated against on the basis of race, color, national origin, ancestry, sex, or religion in any consideration leading to the award of contract.
Bids must be prepared on the approved Bid forms in conformance with the Instructions to Bidders and submitted in a sealed envelope plainly marked on the outside, “SEALED BID FOR THE HERITAGE VALLEY PARKS FOUNTAIN ENTRY FEATURE RENOVATION PROJECT, SPEC. NO. 16-04, DO NOT OPEN WITH REGULAR MAIL.” The bid must be accompanied by certified or cashier’s check, or bidder’s bond, made payable to the City. The bid guaranty shall be an amount equal to ten percent (10%) of the total maximum amount bid with their proposals as required by California law.
SUBCONTRACTOR'S LIST: The bid must state the name, location of the place of business, and the California contractor license number of each subcontractor who will perform work or a subcontractor licensed by the State of California who, under subcontract to the prime contractor, specially fabricates and installs a portion of the work or improvement according to detailed drawings contained in the plans and specifications, in an amount in excess of one-half of 1 percent of the prime contractor's total bid or, in the case of bids or offers for the construction of streets or highways, including bridges, in excess of 0.5% percent of the prime contractor's total bid or $10,000, whichever is greater. The prime contractor shall list only one subcontractor for each portion of the work as is defined by the prime contractor in his or her bid.
CONTRACTOR’S LICENSE: The contract will only be awarded to a bidder who holds a valid California State Contractor’s License with a classification Class “A” in accordance with California Business and Professions Code Section 7000 – 7145 and the bidder must warrant that it and all subcontractors are properly licensed and have all applicable business licenses.
CONTRACT AWARD: The award of contract, if made, will be to the lowest responsive and responsible bidder as determined solely by the City. Responsibility of bidders shall be determined in accordance with the criteria set forth in the Instructions to Bidders. The City reserves the right to reject any or all bids, to waive any irregularity, and to take all bids under advisement for a period of sixty (60) days.
MANDATORY PRE-BID MEETING. There will be a Mandatory Pre-Bid meeting Thursday, July 6, 2017, at 10:00 A.M., in the Public Works Department, 250 Central Avenue, Fillmore, CA 93015.
AWARD OF CONTRACT: Each contractor and subcontractor listed on the bid must be registered with the Department of Industrial Relations pursuant to Labor Code Section 1725.5, subject to the limited exceptions set forth in Labor Code Section 1771.1(a) (regarding the submission of a bid as authorized by Business & Professions Code Section 7029.1 or Public Contract Code Section 10164 or 20103.5, provided the contractor is registered to perform public work pursuant to Section 1725.5 at the time the contract is awarded).
RETENTION: The City will deduct a five percent (5%) retention from all progress payments as specified in Section 9-3.2 of the Standard Specifications for Public Works Construction. The City in accordance with Public Contract Code Sect. 22300 shall permit the substitution of securities for any moneys withheld by a public agency to ensure performance under a contract. The City hereby incorporates herein all of the provisions set forth in Public Contract Code Sect. 22300.
